PRICING
Prices exclude delivery costs. Options for delivery are outlined below.

ORDERING
How is my payment handled?
Once you have contacted me I will be touch asap to discuss payment options. If you live in the UK then bank transfer is one of the easier options. It also means I don’t have to pay credit card fees. As soon as I have received payment the painting will be marked as sold.

FRAMING: Paintings.
Some works are already framed, noted in the description. Rear of paintings have standard backboard and hanging arrangement. I can easily arrange for framing of unframed paintings: A frame/moulding that always set a painting off well best is a 12mm ‘L style’ white moulding. However there are other options we can happily discuss and decide on.

MOUNTED WORK: Monoprints
These come mounted.  I use  Larsson Star White mount board for the window mount. With a solid back board.  Your print comes in a clear and secured cellophane envelop for additional protection.

DELIVERY
Parcel Force/Special Delivery. Delivery prices vary so quotes will be provided at the time of ordering. Please note I can’t send glass-framed work in the post. I am happy to get a quote from a courier for larger items on request.

COLOUR ACCURACY ON THIS SITE
Every care has been taken to show the artwork as accurately as possible with regard to size and colour. The image you see online may show a difference due to slight variation between browsers, devices and screen settings. Any variation between the image represented and the actual artwork is not deemed a fault. Therefore slight inconsistencies will not be a valid reason for return.

SHIPPING
I have placed my order; how soon will I receive my painting?
Original paintings will be packed and shipped within 2 weeks though often they will arrive quicker than this. If you need it quicker, just let me know and in most cases something can be arranged. There may be an extra charge for rush deliveries according to your requirements.

In the UK pieces are sent by Royal Mail, Parcel Force or courier depending on size and weight.  Most UK deliveries arrive within 2 days from time of shipping. I will let you know as soon as your artwork is in the post. Please allow 7 working days in total from the point of despatch.

IN PERSON COLLECTIONS
Can I collect my artwork from your studio? Yes, please contact me to arrange. I live between Cirencester and Swindon. I’d be delighted to welcome you.

SHIPPING INTERNATIONALLY?
Yes, I can ship to most countries, although it will take longer to arrive depending on your location. If your location is restricted once you get to the checkout you need a bespoke courier service. Contact me with your details and the piece you would like, and I can give you shipping options.

Overseas shipments (outside the UK) may be subject to import duties and taxes according to the laws of the destination country. Any additional charges are at the customer’s expense. We have no control over these charges and accept no responsibility for additional charges. Shipping costs also contribute towards packing supplies, labour and transit.

RETURNS
What if my painting arrives and I don’t like it?
I want you to be fully happy with your new artwork, so I offer a Buy-Back agreement.

If a painting is not as you expect, you have 14 days to contact me by email and request a refund. Once a return has been agreed, you are responsible for packing and arranging return delivery using the same service it was sent to you. Once the piece has been safely returned I will refund your payment within 14 days.

What if my painting arrives damaged?
All work is carefully packed and wrapped. If you receive a work that has been damaged in transit, please contact me within 7 days and if possible keep a photograph.

What about Overseas Returns?
At this time I am unable to offer a refund or return on any product(s) sent outside of the UK.

COPYRIGHT
Copyright: Having sold an original artwork, I still retain the copyright and, thus, the right to reproduce the work. The ownership of the physical piece to you as the client but does not extend to the reproduction rights.

TERMS AND CONDITIONS SPECIFICALLY RELATING TO COMMISSIONS
The following terms and conditions apply to the commissions service provided by Tim Baynes Art to you, the Client.

Acceptance
It is not necessary for the Client to have signed any document for these terms and conditions to apply. If the Client commissions a portrait from Tim Baynes Art then the Client will be deemed to have satisfied themselves as to the terms applying and have accepted these terms and conditions in full.

Please read these terms and conditions carefully. Any commission or use services implies that you have read, understood and accepted these terms and conditions.

Price Quotations
Charges for services to be provided by Tim Baynes Art are defined in the price quotation that the Client will receive, upon request, via email. Quotations are valid for a period of 30 days. Tim Baynes Art reserves the right to alter or refuse to honour a quotation after expiry of the 30 days.

Additional Expenses
The Client agrees to reimburse Tim Baynes Art for any additional expenses incurred for the completion of the work. Examples of these instances would be postage charges, extra travel expenses for delivery etc.

Photo Provision/Reference Material
The Client will be required to provide suitable photographs for the commission work to be produced. The Client must have permission to use such photographs & it is their responsibility to not breach any copyright laws.

Artwork progress
Once work commences on a Clients portrait, Tim Baynes Art will email photos of the progress of the Artwork & an estimated completion date. At this stage minor alterations can be made to its design content.

Tim Baynes Art reserves the right to share “painting in progress” photos to social media unless the Client expresses this not to be done. e.g. a surprise present

Once Artwork is complete Tim Baynes Art will email the Client a watermarked digital photo of the finished portrait. At this stage only very minor adjustments can be made.

Copyright
Tim Baynes Art retains the copyright to the artwork created from the Client’s photo. Tim Baynes Art will not reproduce the Artwork & its usage will not be allowed on any other website apart from Tim Baynes Art website and social media pages, unless the Client gives written permission to do so.

Tim Baynes Art reserved the right to display the artwork on their website and social media pages. If a Client is unhappy about the artwork being displayed, they must declare this upon placing the commission.

The Client retains ownership of the artwork but must obtain permission to share the artwork on social media. If the client wishes to make any reproductions of the Artwork then this must be arranged through Tim Baynes Art only.

Deposit
Tim Baynes Art requires a 30% deposit from the Client to confirm a commission slot. This deposit is non-refundable.

Payments
Invoices will be issued by Tim Baynes Art upon completion of the Artwork & before collection/delivery. Invoices are primarily sent via email. The Client will also be required to provide a current postal address to receive hard copy invoices. Payment in full is due within 7 days of invoice. Please note, unless specifically agreed to by both parties prior to the issuing of an invoice, Tim Baynes Art does not accept payment in part or via instalments.

Tim Baynes Art accepts payment by the following methods (in order of preference):
Bank Transfer (BACS)
Credit/Debit Card*
PayPal*

For termination before completion of commission
If the client chooses to terminate the services of Tim Baynes Art after agreeing a commission arrangement but before the commissioned project is complete, Tim Baynes Art reserves the right to retain any non-refundable deposits paid.

Should the Client cancel the commission agreement after the Artwork has been completed, Tim Baynes Art reserves the right to charge up to 85% of the total projected costs. The scale of the charge will be dependent on the discretion of Tim Baynes Art and the stage of the project at the time of cancellation.

If communication breaks down on the part of the Client for a period of 30 days (that is, the Client fails to reply to a communication from Tim Baynes Art ) Tim Baynes Art will issue a warning email. If this warning email is not replied to (and communication does not resume) with a following period of 30 days, Tim Baynes Art reserves the right to terminate the commission. In this event, all deposits paid will be retained by Tim Baynes Art and the commission will be cancelled.

If the Client wishes to continue the commission at a later date they will be required to request a new project quotation, sign a new Commission Agreement and pay a further non-refundable deposit.
